Terms of Service

These Terms govern your use of Athletiq at athletiq.health. By creating an account or using the service, you agree to these Terms.

1. The service

Athletiq is an AI performance platform for hybrid sports. It provides training planning, nutrition guidance, analytics, coaching features, and related tools. Features may change as we improve the product.

2. Accounts

You must provide accurate information and keep your credentials secure. You are responsible for activity under your account. You must be of legal age to form a binding contract in your jurisdiction (and at least 16 where that is the minimum for digital services).

3. Not medical advice

Athletiq content (including AI coaching, training plans, and nutrition guidance) is for informational and sports-performance purposes only. It is not medical, clinical, or dietetic advice. Consult a qualified professional before starting or changing training or nutrition programs, especially if you have injuries or health conditions.

4. Subscriptions and payments

Paid plans are billed through Stripe according to the plan you select. Fees, taxes, renewals, and cancellations follow the checkout and customer portal flows. Unless required by law, fees are non-refundable once a billing period has started.

5. Acceptable use

You agree not to misuse the service, attempt unauthorized access, reverse engineer except where permitted by law, abuse AI endpoints, scrape at scale, or use Athletiq to harm others or violate applicable law.

6. Your content

You retain rights to the data you submit. You grant us a license to host, process, and display that data as needed to operate Athletiq (including sending relevant context to AI subprocessors to generate outputs you request).

7. Intellectual property

Athletiq, its branding, software, and proprietary metrics remain our property or that of our licensors. You receive a limited, non-exclusive right to use the service while your account is in good standing.

8. Availability and disclaimers

We aim for high availability but do not guarantee uninterrupted service. The service is provided “as is” to the fullest extent permitted by law. AI outputs may be inaccurate or incomplete; verify important decisions independently.

9. Limitation of liability

To the maximum extent permitted by law, Athletiq and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or training outcomes. Our aggregate liability for claims relating to the service is limited to the amounts you paid us in the 12 months before the claim (or €50 if you use only a free plan).

10. Termination

You may stop using Athletiq at any time. We may suspend or terminate accounts that violate these Terms or create risk for the platform or other users.

11. Governing law

These Terms are governed by the laws of Spain, without prejudice to mandatory consumer protections in your country of residence. Courts of Spain shall have jurisdiction, except where mandatory law provides otherwise for consumers.

12. Changes

We may update these Terms by posting a new version on this page. Continued use after the effective date constitutes acceptance, except where mandatory law requires otherwise.
